Terms of Use
Any image or resource on Encompass Rose Design or in my DeviantArt Gallery that was posted before November 4, 2012 is strictly for personal, non-commercial use unless otherwise specified.
I offer design resources, textures, and web graphics under several different licenses based on either the time and effort involved in creating them, the licensing terms of the stock or brushes I used to create them or both.
Posts made after November 4, 2012 should be clearly titled and contain preview that tell you what each item can be used for.
Here is the short explanation of terms:
- Unrestricted: Free For Any Creative Use. Cannot be re-sold or redistributed as stock.
- Non-commercial: Free For Personal, Non-commercial Use. Cannot be re-posted as stock.
- Sample: For Sample Purposes Only. Not for Download or Use As Stock.
- Supporter Exclusive: For Website Supporters Only. Visit the Site Supporters Page for more info.
- Creative Commons SA: Free for any creative use. Free redistribution is allowed, provided that the zip files remain intact and all of the original documents (TOU, link to this site, ALL preview images, etc) are included. May not be bundled with other resources in a "best of" pack or anything like that unless every resource in your pack has appropriate credits given. You must notify me by email if you intend to redistribute my files.
- Public Domain: No copyright restrictions. You can copyright your finished work as long as my resource is significantly altered or is not the focus of the work. You can redistribute a public domain resource, but you may not restrict others from doing so or sell the resource as is.
- Text Content: You may not re-print, republish, or otherwise use any text content on my blog or gallery, including tutorial content, except for articles that are clearly labeled with a Creative Commons license.
Here is the full explanation of terms:
With Unrestricted Stock and Resources, you may:
- Create artwork and designs for your clients, in both print or web based media
- Create linkware graphics, templates, etc.
- Create other resources to distribute on your website or gallery.
- Create items intended for commercial use by you or your clients/site users.
- Create items for your personal blog, website, or print project.
- Post links to my original resource posts in your blog or other places, but you must link back to the original post on my blog or gallery.
- Sell, share, or redistribute my resource as is on your website or upload my content to a sharing site. (Even if you list my name as the creator.)
- Give out my download links to your peers or website users.
- Directly link to any resource on my site or gallery from your website.
- Create content meant to bribe web users into following your site or social media feeds. This means: No "Facebook fan freebies," "Twitter exclusives," or "members only" content of any kind on any website. (I have nothing against social media or members only content. If you want to build your fan base, I suggest you make your own stock from scratch.)
- Restrict where other users can post their artwork if you make stock from my stock.
With Non-Commercial Stock and Resources you may:
- Create items for your personal blog, website, or charity publication, provided that the publication will not be mass produced or sold. (No more than 50 copies. If you need more than that, contact me with details about your project.)
- Create free resources for your website users.
- Post links to my resources in your blog or other places, but you must link back to the original post on my blog or gallery.
- Create content meant to bribe web users into following your site or social media feeds. This means: No "Facebook fan freebies," "Twitter exclusives," or "members only" content of any kind on any website.
- Restrict where other users can post their artwork if you make stock from my stock.
- Create any item for sale or commercial purposes, including a freebie that you offer to customize for money. Commercial use includes ANY kind of currency, including website-specific economy or trading.
- Post direct links to any content on my site or gallery.
- Sell, share, or redistribute my resource as is on your website or upload my content to a sharing site. (Even if you list my name as the creator.)
- Give out my download links to your peers or website users.
With Sample Content, you may:
- View the item in my website or gallery.
- Post links to my original sample posts.
- Download
- Alter
- Use as stock
- Directly link to my sample content from your site.
With Supporter Exclusive Content, You may:
- Create artwork and designs for your clients, in both print or web based media
- Create exclusive content for your members, followers, etc.
- Create linkware graphics, templates, etc.
- Create other resources to distribute on your website or gallery.
- Create items intended for commercial use by you or your clients/site users.
- Create items for your personal blog, website, or print publication.
- Post links to my original resource posts in your blog or other places, but you must link back to the original post on my blog or gallery.
You may not:
- Sell, share, or redistribute my resource as is on your website or upload my content to a sharing site. (Even if you list my name as the creator.)
- Give out my download links to your peers or website users.
- Directly link to any resource on my site or gallery from your website.
With Creative Commons Share Alike Content you may:
- Create artwork and designs for your clients, in both print or web based media
- Create linkware graphics, templates, etc.
- Create other resources to distribute on your website or gallery.
- Create items intended for commercial use by you or your clients/site users.
- Create items for your personal blog, website, or print project.
- Redistribute my content as long as stock packs remain zipped together with all of their original files, including any previews, TOU, or credit information.
You may not:
- Sell my content as is in any form, including repackaged with other content.
- Redistribute my content without the original documentations included in the zip file
- Unzip stock packages and upload the separate pieces to your gallery or website.
With Public Domain Content You May:
- Create artwork and designs for your clients, in both print or web based media
- Create linkware graphics, templates, etc.
- Create other resources to distribute on your website or gallery.
- Create items intended for commercial use by you or your clients/site users.
- Create items for your personal blog, website, or print project.
- Redistribute my content for free or as part of your software or download packages.
You may not:
- Sell my content as a standalone resource
- Claim that you created my content or imply that you did by charging for it.
- Restrict anyone else from redistributing or using the content.
Here are some related points and general rules:
Credit:
Credit is usually not required for use of my downloadable content. Content marked as "made for" another website or group may require credit and you should check the post for terms of use. Otherwise, a link back is requested wherever possible, but it's not mandatory.
Commissions and customizations:
If you commission me to create something for you, it's yours. You can use it however you like and set whatever terms you like as long as I am paid fairly. I reserve the right to place a copy of the commissioned work in my portfolio and to display the work on my websites or online galleries.
Donations:
Donations are completely optional. The rule of thumb I use is simply "Don't be a jerk." If you're using my content for a commercial project like a CD cover or a scrap kit, then a free copy or the cash equivalent would be nice. Otherwise, throw me a couple of bucks or some DA points if you have it to spare. I do have gifts for people who donate. You can read more about those here and here.
Share Alike
Really. Don't use my free content to create "member's only" or exclusive resources to get people to follow your blog, friend you, add you on twitter, join your group, etc. This is the one point I'm going to be a real stickler on. Most stock providers will not let you create stock from theirs at all. I don't mind if you want to remix my stuff; in fact I'm flattered, but I don't want to see my stuff used to bribe your users this way. Exclusive content implies that you put an extra level of work into the resource. If you're going to re-mix my content for your resources, post it with the exact same (absolutely free for everyone) terms.
Creating gift packages that you give to your friends and current followers is fine, and so is creating artwork for sale, but do not create semi-private resources for the purposes of gaining more fans/followers/members etc.
Creative Use
I state that my resources are free for any creative use. I realize that everyone's definition of creative is different, but here is an example of what I mean. My cloud texture is not the focus of this work. The artist used to create something unique and completely different (and my favorite color, which is a nice bonus. I don't want to see my resources cut, recolored, and then re-uploaded as your work. I want to see you do something with them.
Charity Use
You're free to use my unrestricted content as you like. For non-commercial content, I can sometimes let you raise money with my stock, but you need to contact me first. A lot of the non-commercial packs were made using third party brushes or other stock and I have to abide by the creators' terms.
Open Source Use
Contact me with details on your project and I'll probably be able to lift any restrictions on redistribution for you. I'll rarely ever say no, I just want to know what the stock's being used for.
Commercial Licensing for free, non-commercial stock
As stated above, a lot of the non-commercial packs were made using third party brushes or other stock and I have to abide by the creators' terms. If you really want or need to use something, contact me by email. I'll see what I can do to accommodate you.
